Collaborative Divorce
In our collaborative divorce practice, we support, protect, and guide our clients through a process outside the courtroom. A collaborative divorce follows the same non-adversarial, interest-based philosophy as mediation, except that each party has their own attorney at the table.
The collaborative process is an excellent alternative to mediation if you have difficulty communicating with your partner, if there is a power imbalance, or if you feel more comfortable having an advocate with you during negotiations.
Within the collaborative process, we have neutral professionals at the table to help facilitate all areas of the divorce agreement including financial/tax experts, mental health coaches and/or child specialists as needed. As your collaborative attorney, we work together as a team, along with your spouse and his/her attorney, to find solutions that meet everyone’s needs. The cornerstone of the collaborative process is that all parties and professionals sign a contract that emphasizes a commitment to work collaboratively and stay out of court, this is known as the “Participation Agreement.”
Once a Participation Agreement has been reached, we work on your behalf, together with your spouse’s collaborative attorney, to draft a legally enforceable divorce agreement reflecting your mutual understanding, file all necessary papers, and present the divorce agreement to the court for approval.
